KORUTA TERMS OF USE

Welcome to the Koruta website (the “Site”). The Site is owned and controlled by Koruta LLC, a Delaware limited liability company (“Koruta,” “we,” “us,” or “our”).

By accessing or using this Site, purchasing products, or interacting with our content, you agree to be bound by these Terms of Use (“Terms”). PLEASE READ THESE TERMS CAREFULLY. If you do not agree to these Terms, you may not use the Site.

1. ACCEPTANCE OF TERMS

Your use of this Site constitutes your legally binding agreement to these Terms. We may update these Terms at any time without prior notice. Your continued use of the Site following any changes constitutes your acceptance of the new Terms.

2. INTELLECTUAL PROPERTY RIGHTS

All content on this Site, including but not limited to text, graphics, logos, images, “Siren/Bold” narratives, product descriptions, video content, code, and the compilation thereof (collectively, “Koruta Content”), is the property of Koruta or its licensors and is protected by United States, Canadian, and international copyright and trademark laws.

You agree not to reproduce, distribute, display, or create derivative works of any Koruta Content without our express written permission. You may not use our product descriptions—which link design to specific linguistic or cultural meanings—for any commercial purpose outside of this Site.

3. TERMS OF SALE AND “COMBO” POLICY

Purchase Requirements:
Certain products on the Site are sold exclusively as “Combos,” “Matched Sets,” or “Bundles” (e.g., a Hand Combo consisting of a ring and bracelet). You acknowledge that these items are designed and sold as a single stylistic unit.

Return Policy for Combos:
IF YOU PURCHASE A “COMBO” OR “MATCHED SET,” YOU MUST RETURN THE ENTIRE SET TO BE ELIGIBLE FOR A REFUND OR EXCHANGE. PARTIAL RETURNS OF INDIVIDUAL COMPONENTS FROM A COMBO ARE NOT ACCEPTED. Koruta reserves the right to refuse any return that is incomplete.

Pricing and Availability:
All prices are shown in the currency selected on the Site (USD or CAD). We reserve the right to correct pricing errors, even after an order has been submitted. If a pricing error is discovered, we will cancel the order and refund you.

4. SHIPPING AND TAXES

Domestic Fulfillment (USA & Canada):
We maintain inventory in both the United States and Canada.

USA Orders: Shipped from our US facility. US customers will not be charged customs duties.
Canada Orders: Shipped from our Canadian facility. Canadian customers will not be charged customs duties.

Sales Tax & GST/HST:
Applicable taxes are calculated at checkout based on your shipping address:

For US Customers: Sales tax will be collected where required by law (specifically in states where we have a physical presence, such as our warehouse location).
For Canadian Customers: GST, HST, and/or QST will be collected based on the province of delivery.

International Orders (Outside USA/Canada):
If we elect to ship to a country outside of the USA or Canada, the recipient is the importer of record and must comply with all laws and regulations of the destination country. Additional charges for customs clearance must be fulfilled by the recipient; Koruta has no control over these charges, nor can we predict what they may be.

5. USER CONTENT AND REVIEWS

If you post reviews, photos, or comments (“User Content”) on our Site or social media channels, you grant Koruta a non-exclusive, royalty-free, perpetual, and irrevocable right to use, reproduce, modify, and display such content throughout the world in any media (including marketing emails and social media ads).

You represent that your User Content does not violate the privacy or rights of any third party and is not defamatory, obscene, or unlawful.

6. DISCLAIMER OF WARRANTIES

THE SITE AND ALL PRODUCTS AND SERVICES INCLUDED ON OR OTHERWISE MADE AVAILABLE TO YOU THROUGH THIS SITE ARE PROVIDED BY KORUTA ON AN “AS IS” AND “AS AVAILABLE” BASIS, UNLESS OTHERWISE SPECIFIED IN WRITING.

KORUTA MAKES NO REPRESENTATIONS OR WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, AS TO THE OPERATION OF THE SITE OR THE INFORMATION, CONTENT, MATERIALS, PRODUCTS OR SERVICES INCLUDED ON OR OTHERWISE MADE AVAILABLE TO YOU THROUGH THIS SITE. YOU EXPRESSLY AGREE THAT YOUR USE OF THIS SITE IS AT YOUR SOLE RISK.

TO THE FULL EXTENT PERMISSIBLE BY APPLICABLE LAW, KORUTA DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING, BUT NOT LIMITED TO, IMPLIED WARRANTIES OF MERCHANTABILITY AND FITNESS FOR A PARTICULAR PURPOSE. KORUTA DOES NOT WARRANT THAT THE SITE, INFORMATION, CONTENT, MATERIALS, PRODUCTS OR SERVICES INCLUDED ON OR OTHERWISE MADE AVAILABLE TO YOU THROUGH THIS SITE, OUR SERVERS, OR ELECTRONIC COMMUNICATIONS SENT FROM KORUTA ARE FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS.

7. LIMITATION OF LIABILITY

UNDER NO CIRCUMSTANCES SHALL KORUTA, ITS DIRECTORS, OFFICERS, EMPLOYEES, AFFILIATES, OR AGENTS BE LIABLE FOR ANY DIRECT, INDIRECT, INCIDENTAL, PUNITIVE, SPECIAL, OR CONSEQUENTIAL DAMAGES ARISING FROM THE USE OF THIS SITE OR FROM ANY INFORMATION, CONTENT, MATERIALS, PRODUCTS, OR SERVICES INCLUDED ON OR OTHERWISE MADE AVAILABLE TO YOU THROUGH THIS SITE, INCLUDING, BUT NOT LIMITED TO, DAMAGES FOR LOSS OF PROFITS, GOODWILL, USE, DATA, OR OTHER INTANGIBLE LOSSES, EVEN IF KORUTA HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

CERTAIN STATE OR PROVINCIAL LAWS DO NOT ALLOW LIMITATIONS ON IMPLIED WARRANTIES OR THE EXCLUSION OR LIMITATION OF CERTAIN DAMAGES. IF THESE LAWS APPLY TO YOU, SOME OR ALL OF THE ABOVE DISCLAIMERS, EXCLUSIONS, OR LIMITATIONS MAY NOT APPLY TO YOU, AND YOU MIGHT HAVE ADDITIONAL RIGHTS.

8. GOVERNING LAW AND JURISDICTION

These Terms and your use of the Site shall be governed by and construed in accordance with the laws of the State of Delaware, USA, without regard to its conflict of law principles.

Binding Arbitration:
Any dispute or claim relating in any way to your use of the Site, or to any products or services sold or distributed by Koruta, will be resolved by binding arbitration, rather than in court, except that you may assert claims in small claims court if your claims qualify. The Federal Arbitration Act and federal arbitration law apply to this agreement.

Venue:
If for any reason a claim proceeds in court rather than in arbitration, you and Koruta each waive any right to a jury trial and agree that any such proceeding shall be conducted exclusively in the state or federal courts located in Delaware.
